The TIO update and thinking again on how best to develop consumer regulation

TelSoc has pleasure in announcing its next online lunchtime event on Thursday, 21 September 2023, from 12.30 pm.

A number of important developments involving the TIO have occurred recently.  The first is the continuing reduction in the number of complaints by consumers about the services provided by telecommunications operators.  This is to be welcomed, particularly if the reduction is for the right reasons.  The second development is that the TIO has called for a different model – direct regulation – to be adopted for regulation in the sector where it impacts on consumers.  This call has occurred at a time when the Consumer Protection Code is progressing through the approval stages.  Over the past twenty-five years in Australia, the preferred approach to the development of industry codes of practice has been largely by the industry, with subsequent regulatory adoption by the ACMA.  Is this model serving Australia well in the current environment?

Cynthia Gebert, the TIO, will present on the state of consumer regulation and consumer code development.  She will also review the current level of complaints and canvass reasons for the recent significant decline in complaints in some areas.

Karen Lee, Senior Lecturer in Law at the University of Technology, Sydney, and a TelSoc member, will follow the TIO and identify possible frameworks for assessing the effectiveness and suitability of various approaches to regulation – direct regulation, co-regulation and industry self-regulation – and where each tool might be best suited to the regulatory task.

The presentations will be followed by a Question-and-Answer session.  TelSoc is all about sharing ideas and encouraging useful discourse within the sector.  Both of our speakers have indicated that they are happy to field as many questions as time will allow.

Cynthia Gebert

Cynthia Gebert commenced in the role of Telecommunications Industry Ombudsman in May 2022. Her nationally recognised leadership in dispute resolution and outstanding experience as a CEO underpin her commitment to improving outcomes for consumers and telcos. 

Cynthia is the Chair of the Australian and New Zealand Ombudsman Association (ANZOA) and is a 2011 alumni of Leadership Victoria’s highly respected Williamson Community Leadership Program. She is also a member of Chief Executive Women.

Prior to joining the TIO, Cynthia held the position of Victoria’s Energy and Water Ombudsman for ten years. She has a Masters degree in Dispute Resolution from the University of Technology, Sydney and bachelor’s degrees in Law and Political Science from the University of Sydney. 

Karen Lee

Dr Karen Lee is a Senior Lecturer in the Faculty of Law at UTS and a communications law specialist. Her research spans telecommunications, media and digital platform regulation. Karen is the author of The Legitimacy and Responsiveness of Industry Rule-making, published by Hart in 2018, and has published in leading Australian and international academic journals, including the Federal Law Review and Journal of Media Law.

Karen is a chief investigator on two projects funded by the Australian Research Council. The first is Optimising Industry-led Regulation for the Digital Platforms Era; the second is the International Digital Policy Observatory. With Holly Raiche, Derek Wilding, and Anita Stuhmcke, she is the co-author of the Centre for Media Transition’s report Digital Platform Complaint Handling: Options for an External Dispute Resolution Scheme.
